By agreeing to join everwalk.com, I (hereafter designated as PARTICIPANT) acknowledge that participating in the EVERWALK Event/Events is voluntary and at my own risk. I acknowledge that I am in good health and can safely participate. I understand that EVERWALK cannot guarantee that no injury will occur.
In consideration of the opportunity to participate in the Event/Events, PARTICIPANT hereby waives, releases and discharges EVERWALK, its owners, officers, board members, operators, volunteers, directors, employees , associates and partners, and their owners, officers, employees, and volunteers (collectively EVERWALK), involved in the operation of the Event, from all liability for or by any reason of any damage, loss or injury to person and/or property of any kind or character, even injury resulting in death, that has been or may be sustained in consequence of participation in the event regardless of whether the damage, loss or injury to person and/or property may have been wholly or partly caused by the intention, deliberate or negligent conduct of EVERWALK.
In further consideration of the opportunity to participate in the Event, PARTICIPANT, hereby agrees to indemnity and hold harmless EVERWALK from and against any and all claims of third parties for personal injury and property damage which may result from or be caused by my own intention, deliberate or negligent conduct.
PARTICIPANT represents and warrants that he/she is physically fit and able to participate in the Event.
PARTICIPANT acknowledges and fully understands that, by executing this AGREEMENT, he/she will be forever prevented from suing or otherwise making any claim against EVERWALK for damage, loss or injury to person and/or property that may be sustained while participating in or preparing for the Event.
PARTICIPANT hereby grants EVERWALK free of charge all ownership rights in any photographs, video, or any other record of my image as a participant in any Event for use solely by EVERWALK.
PARTICIPANT ACKNOWLEDGES THAT HE/SHE HAS FULLY AND CAREFULLY READ THIS AGREEMENT, FULLY UNDERSTANDS THIS AGREEMENT, AND BY JOINING THE EVERWALK WEBSITE IS FREELY AND VOLUNTARILY EXECUTING THIS AGREEMENT. PARTICIPANT ACKNOWLEDGES AND FULLY UNDERSTANDS THAT, BY EXECUTING THIS AGREEMENT, HE/SHE IS WAIVING CERTAIN LEGAL RIGHTS THAT PARTICIPANT, HIS/HER SPOUSE, NEXT OF KIN, DEVISEES, HEIRS, EXECUTORS, ADMINISTRATORS, AND PERSONAL REPRESENTATIVES MAY HAVE AGAINST EVERWALK.
